You are responsible for reviewing all information submitted through our website, online forms, appointment systems, documents, applications, fingerprinting transactions, and other records before submission or processing.

Information may include, without limitation, your name, date of birth, Social Security number when required, citizenship information, demographic information, physical descriptors, employer information, requesting agency information, ORI number, OCA number, agency identifiers, service type, and other information necessary to provide the requested service.

You are responsible for obtaining the correct ORI, OCA, agency identifier, service code, application information, and other instructions required for your particular transaction.

Broward Fingerprinting may assist with identifying or reviewing information when reasonably possible, but we do not guarantee that information provided by a third party is accurate or appropriate for your specific application.

3. IDENTITY VERIFICATION AND REQUIRED DOCUMENTS

You must provide valid, unexpired, acceptable identification and any documentation required for the service requested.

We may refuse, delay, or discontinue a service when:

• Required identification is unavailable, expired, altered, damaged, inconsistent, or reasonably suspected to be fraudulent;

• Required documentation or information is missing;

• We cannot reasonably verify identity;

• Providing the service would violate applicable law, regulation, governmental requirements, professional standards, or Company policy; or

• Circumstances reasonably create concerns involving fraud, safety, unlawful activity, or misuse of our services.

Fees already earned or expenses already incurred may remain non-refundable to the extent permitted by law and these Terms.

4. ONLINE FORMS AND ELECTRONIC SUBMISSIONS

Our website may provide online forms, pre-registration forms, questionnaires, appointment requests, service intake forms, consent forms, and other methods of electronically submitting information.

By submitting an online form, you certify that the information provided is complete and accurate to the best of your knowledge.

You understand that:

• Submission of an online form does not guarantee an appointment;

• Submission does not guarantee acceptance or completion of any service;

• Submission does not guarantee successful processing of fingerprints;

• Submission does not guarantee approval of a license, application, employment position, permit, background screening, or governmental request;

• We may contact you to request additional information or documentation;

• We may correct obvious formatting errors or contact you regarding suspected errors, but you remain responsible for the substantive accuracy of information submitted; and

• Information submitted electronically may be processed, transmitted, stored, or accessed through third-party technology providers used to operate our business.

You agree not to submit information belonging to another individual unless you are legally authorized to provide that information.

5. FINGERPRINTING AND BACKGROUND SCREENING SERVICES

Broward Fingerprinting provides fingerprint capture, fingerprint card preparation, electronic fingerprint transmission, and related services.

We do not control and cannot guarantee:

• Fingerprint quality acceptance by a governmental agency;

• Background screening results;

• Processing times;

• Governmental system availability;

• Agency decisions;

• Licensing decisions;

• Employment decisions;

• Eligibility determinations;

• Delays caused by third parties;

• Requests for additional information;

• Rejections or resubmissions required by an agency; or

• The accuracy or completeness of records maintained by governmental agencies or third parties.

Fingerprint quality may be affected by age, occupation, medical conditions, skin conditions, injuries, worn fingerprint ridges, moisture, dryness, scarring, movement, or other circumstances outside our control.

We will use reasonable professional efforts to obtain acceptable fingerprints.

A rejection by an agency does not, by itself, establish negligence or wrongdoing by Broward Fingerprinting.

Reprinting and Resubmission

If fingerprints are rejected due to fingerprint quality, we may provide a reprint or resubmission according to our applicable service policy, contractual obligations, governmental requirements, and the circumstances of the transaction.

Additional fees may apply when a rejection, resubmission, or repeat service results from:

• Incorrect information supplied by the customer or a third party;

• An incorrect ORI, OCA, agency identifier, or service selection;

• Failure to follow agency instructions;

• Expiration of a required submission period;

• A new application or transaction being required;

• Customer-requested changes; or

• Circumstances outside Broward Fingerprinting's reasonable control.

6. GOVERNMENT AGENCIES AND THIRD-PARTY RESULTS

Broward Fingerprinting is an independent service provider.

Unless expressly stated otherwise, we do not act as an agent, representative, employee, or decision-maker for any governmental agency, licensing board, employer, requesting agency, law enforcement agency, regulatory authority, or other organization.

Payment to Broward Fingerprinting does not guarantee approval, acceptance, licensing, employment, certification, clearance, eligibility, or any particular result.

You are responsible for complying with deadlines, application requirements, licensing requirements, governmental instructions, and requests for additional information.

7. NOTARY AND LOAN SIGNING SERVICES

You understand that Broward Fingerprinting and its notaries are not acting as your attorneys unless a separately retained licensed attorney expressly agrees in writing to provide legal representation.

Our non-attorney personnel do not provide legal advice, select legal documents for customers, determine customers' legal rights, or represent customers in legal proceedings.

You are responsible for:

• Providing acceptable identification;

• Appearing before the notary when required;

• Understanding the document being signed;

• Ensuring documents are complete and ready for notarization;

• Providing competent witnesses when required unless other arrangements have been made; and

• Consulting a licensed attorney regarding legal questions.

A notary may refuse to perform a notarization when required or permitted by law or when there are reasonable concerns regarding identity, willingness, awareness, competency, fraud, coercion, document completeness, or legality.

8. DOCUMENT ASSISTANCE AND NON-ATTORNEY DISCLOSURE

BROWARD FINGERPRINTING, LLC IS NOT A LAW FIRM AND DOES NOT PROVIDE LEGAL ADVICE OR LEGAL REPRESENTATION.

Document assistance services are limited to services that may lawfully be performed by a non-attorney.

We do not determine your legal rights, select legal strategies, advise you which legal document to use, interpret laws for you, or guarantee the outcome of any legal, administrative, immigration, expungement, guardianship, court, governmental, or other proceeding.

You are responsible for reviewing documents before signing or filing them and for obtaining advice from a licensed attorney when appropriate.

9. APOSTILLE AND DOCUMENT AUTHENTICATION SERVICES

Broward Fingerprinting may provide assistance with apostille, authentication, certification, courier, and document-processing services.

We do not control processing times, governmental decisions, foreign-government requirements, courier performance, mail delivery, document acceptance, or requirements imposed by the Florida Department of State, the U.S. Department of State, foreign embassies, consulates, courts, clerks, governmental agencies, or other third parties.

Estimated processing times are not guarantees.

Fees paid to governmental agencies, couriers, shipping providers, and other third parties may be non-refundable according to those providers' policies.

10. PASSPORT AND IDENTIFICATION PHOTOGRAPH SERVICES

Broward Fingerprinting may provide passport photographs and other identification photographs.

We will use reasonable efforts to produce photographs consistent with the requirements communicated to us.

Final acceptance of a photograph is determined by the governmental agency, organization, or other recipient reviewing the photograph.

We do not guarantee acceptance when rejection results from changed requirements, application errors, customer appearance changes, agency discretion, customer-provided information, or circumstances outside our reasonable control.

11. WEDDING OFFICIANT SERVICES

Clients are responsible for obtaining a valid marriage license and satisfying all legal requirements applicable to their marriage.

The required marriage license must be presented to the officiant before the ceremony when required.

Broward Fingerprinting does not guarantee the issuance or validity of a marriage license.

Clients are responsible for providing accurate information, meeting governmental deadlines, and complying with instructions from the issuing clerk of court or other governmental authority.

Ceremony times, locations, witnesses, guests, special requests, and other arrangements must comply with the service purchased and any separately agreed terms.

We may refuse or discontinue a ceremony when providing the service would violate law, create an unsafe environment, involve threats or abuse, or require the officiant to participate in unlawful conduct.

12. MOBILE SERVICE REQUIREMENTS

For mobile services, you agree to provide a lawful, reasonably clean, safe, accessible, and suitable location for the service.

Depending on the service, we may require:

• Adequate lighting;

• A stable table, desk, or work surface;

• Access to electricity;

• Reasonable access to cellular or internet service;

• Protection from weather;

• Sufficient space to safely operate equipment; and

• A reasonably quiet or controlled environment when necessary.

We may refuse, suspend, or terminate a mobile appointment when conditions are unsafe, unsanitary, threatening, abusive, unlawful, excessively disruptive, inaccessible, or otherwise unsuitable for providing the requested service.

13. CHILDREN, PETS, GUESTS, AND SAFETY

Children and minors must be appropriately supervised by a responsible adult.

Animals must be safely secured when reasonably necessary to protect our personnel, customers, equipment, and others.

Customers are responsible for the behavior of household members, employees, guests, invitees, and other individuals present at a service location.

We may immediately terminate an appointment due to:

• Threats;

• Harassment;

• Verbal or physical abuse;

• Weapons displayed or used in a threatening manner;

• Illegal activity;

• Dangerous animals;

• Unsafe property conditions;

• Intoxication that interferes with the service;

• Sexual harassment or inappropriate conduct; or

• Any circumstance that reasonably threatens the safety of our personnel, customers, equipment, or others.

Fees already earned, travel charges, and expenses incurred may remain non-refundable to the extent permitted by law.

14. PARKING, ACCESS, TOLLS, AND LOCATION REQUIREMENTS

Customers requesting mobile services are responsible for providing accurate location information and reasonable access to the service location.

You are responsible for notifying us in advance of:

• Gate codes;

• Security procedures;

• Parking restrictions;

• Building access requirements;

• Loading requirements;

• Required permits;

• Toll roads;

• Valet parking;

• Paid parking; and

• Other access-related conditions.

Additional parking, toll, valet, access, or similar expenses may be charged to the customer when disclosed in advance or reasonably incurred in providing the requested service.

15. APPOINTMENTS, ARRIVAL TIMES, AND SERVICE WINDOWS

Appointment times are estimates and may be affected by traffic, weather, emergencies, previous appointments, governmental systems, equipment issues, or other circumstances.

We will make reasonable efforts to arrive and provide services within the scheduled time.

You agree to provide accurate contact information and remain reasonably available for appointment-related communications.

If you are late, unavailable, unprepared, lack required identification or documents, or cannot provide access to the service location, we may shorten, reschedule, or cancel the appointment.

16. PRICES, PAYMENTS, DEPOSITS, AND FEES

Prices may vary based on service type, location, travel distance, number of customers, after-hours service, urgency, governmental fees, third-party charges, shipping, parking, tolls, and other applicable factors.

Payment may be required in advance, at booking, upon arrival, before transmission or submission, or upon completion of the service.

Deposits and booking fees may be required to reserve appointment times.

Any applicable cancellation, travel, mobile service, governmental, processing, shipping, parking, toll, after-hours, rush, or third-party fees will be disclosed when reasonably practicable.

You agree to pay all charges authorized in connection with services you request.

17. CANCELLATIONS, RESCHEDULING, AND NO-SHOWS

Unless a different policy is disclosed for a particular service, we request at least 24 hours' notice for cancellations or rescheduling.

A customer may be considered a no-show when the customer:

• Is not present or available within 15 minutes of the scheduled appointment time;

• Does not provide access to the service location;

• Does not respond to reasonable attempts to make contact;

• Does not have required identification or documents;

• Refuses to cooperate with requirements necessary to perform the service; or

• Is otherwise unable to proceed with the scheduled service due to circumstances within the customer's control.

Deposits, booking fees, travel fees, after-hours fees, and expenses already incurred may be non-refundable to the extent disclosed at booking and permitted by law.

We may waive or modify fees in our discretion.

18. REFUNDS

Except as otherwise required by law or expressly stated in a service-specific policy, fees for completed services are non-refundable.

Government fees, third-party charges, processing fees, shipping charges, travel fees, booking fees, deposits, and expenses already incurred may be non-refundable.

A customer's dissatisfaction with a governmental result, background screening result, licensing decision, agency processing time, third-party delay, or other matter outside our reasonable control does not automatically entitle the customer to a refund.

If Broward Fingerprinting makes a material error in performing a service, our responsibility may include, as appropriate under the circumstances, correcting the error, repeating the affected service, or providing another reasonable remedy.

Nothing in these Terms eliminates any refund or remedy required by applicable law.

19. CHARGEBACKS, PAYMENT DISPUTES, AND RETURNED PAYMENTS

You agree to contact Broward Fingerprinting promptly regarding billing questions or service disputes so that we have a reasonable opportunity to investigate and attempt to resolve the matter.

You agree not to knowingly initiate a fraudulent, false, or misleading chargeback or payment dispute.

We may provide appointment records, signed acknowledgments, electronic acceptance records, communications, service records, transaction information, and other relevant evidence to payment processors, banks, card issuers, or other financial institutions when responding to a payment dispute.

Returned checks, reversed payments, failed payments, and other unpaid balances may be subject to lawful fees and collection efforts.

20. THIRD-PARTY SERVICE PROVIDERS

Broward Fingerprinting uses third-party providers to operate our business and provide services.

These providers may include website providers, online form providers, scheduling platforms, payment processors, communications providers, customer management systems, cloud service providers, fingerprinting technology vendors, background screening systems, governmental transmission systems, couriers, shipping companies, accounting providers, and other service providers.

You understand that information may be transmitted to, processed by, stored with, or accessed through these providers as reasonably necessary to provide requested services and operate our business.

Third-party providers operate under their own terms, policies, security practices, availability, and legal obligations.

Broward Fingerprinting is not responsible for outages, interruptions, processing delays, data losses, service failures, or other acts or omissions of independent third-party providers except to the extent liability cannot lawfully be excluded.

Our collection, use, and disclosure of personal information are further described in our Privacy Policy.

21. THIRD-PARTY SHARING AND AUTHORIZED DISCLOSURES

You authorize Broward Fingerprinting to disclose information when reasonably necessary to:

• Provide the services you request;

• Submit fingerprinting transactions;

• Communicate with requesting agencies and authorized recipients;

• Process payments;

• Schedule and manage appointments;

• Operate our website and online forms;

• Provide customer service;

• Prevent fraud and protect security;

• Comply with law, subpoenas, court orders, legal processes, governmental requests, and regulatory requirements;

• Establish, exercise, or defend legal claims; or

• Protect the rights, property, safety, and legal interests of Broward Fingerprinting, our personnel, customers, service providers, or others.

Information may also be disclosed with your consent or at your direction.

Additional information regarding our privacy practices is provided in our Privacy Policy.

22. PHOTO, VIDEO, AUDIO, TESTIMONIALS, AND MEDIA RELEASE

Broward Fingerprinting may photograph, film, record, or otherwise capture media in connection with weddings, ceremonies, community events, mobile service visits, business activities, customer testimonials, promotional activities, and other services or events.

Merely visiting our website, booking an appointment, submitting an online form, or purchasing a service does not automatically authorize Broward Fingerprinting to use an identifiable person's name, photograph, portrait, voice, video, likeness, testimonial, or other identifiable media for commercial advertising or promotional purposes.

When Broward Fingerprinting seeks to use identifiable media for advertising or promotional purposes, appropriate consent may be obtained through a separate Media Release, electronic checkbox, written authorization, recorded authorization, or other legally valid method.

When a person provides media consent, and subject to the specific authorization presented to that person, the person may authorize Broward Fingerprinting to:

• Photograph, film, record, or otherwise capture the person's image, likeness, voice, testimonial, appearance, or participation;

• Reproduce, edit, crop, adapt, publish, display, distribute, and use authorized media;

• Use authorized media on websites, social media platforms, advertisements, printed materials, brochures, flyers, promotional videos, business presentations, digital marketing, and other lawful promotional materials;

• Use authorized media without additional compensation, royalties, or payment unless otherwise agreed in writing; and

• Continue using materials already lawfully created, printed, published, distributed, or placed into circulation before a withdrawal request, subject to the terms of the applicable Media Release and applicable law.

Broward Fingerprinting will not use fingerprint images, biometric information, Social Security numbers, government-issued identification documents, background screening information, or confidential service records for advertising or promotional purposes.

Customers who do not consent to promotional media use may still receive services, unless photography or recording is an essential and clearly disclosed component of the specific service or event.

Additional terms governing authorized media use may be provided in a separate Media Release or consent authorization.

23. MEDIA REMOVAL REQUESTS

A person who previously authorized promotional use of identifiable media may contact Broward Fingerprinting to request that we discontinue future use of that media.

We will make reasonable efforts to stop future use and remove identifiable media from websites, social media accounts, and other promotional materials under our direct control, subject to applicable law and the terms of the authorization provided.

We cannot guarantee removal of:

• Materials already printed or physically distributed;

• Content previously shared, reposted, copied, downloaded, archived, cached, indexed, or distributed by third parties;

• Content outside our ownership or reasonable control; or

• Materials that we are legally entitled or required to retain.

A removal request does not automatically create liability for lawful uses occurring before the request was received or processed.

24. MINORS AND MEDIA CONSENT

A parent, legal guardian, or other person legally authorized to provide consent must authorize promotional use of identifiable photographs, videos, audio recordings, names, voices, likenesses, or testimonials of minors when such consent is required by law.

A person providing authorization on behalf of a minor represents that they have legal authority to provide that authorization.

25. PRIVACY POLICY

Our collection, use, processing, storage, retention, and disclosure of personal information are governed by our Privacy Policy.

By submitting information or using our services, you acknowledge that you have been provided access to our Privacy Policy.

Acknowledgment of the Privacy Policy does not, by itself, constitute consent to use your identifiable image, likeness, voice, or testimonial for commercial advertising or promotional purposes.

26. SMS, EMAIL, AND ELECTRONIC COMMUNICATIONS

By providing contact information, you authorize us to send communications reasonably necessary to respond to inquiries, manage appointments, provide requested services, complete transactions, and communicate service-related information.

Marketing or promotional text messages and emails will be sent only when permitted by applicable law and when any legally required consent has been obtained.

Message and data rates may apply.

You may follow applicable unsubscribe instructions or contact us to request that marketing communications stop.

Opting out of marketing communications does not prevent service-related communications that are necessary to complete requested transactions, respond to inquiries, or provide services.

27. ELECTRONIC ACCEPTANCE, SIGNATURES, AND RECORDS

You agree that electronic actions may be used to demonstrate acceptance of agreements, disclosures, acknowledgments, authorizations, and other records.

Electronic actions may include:

• Checking an acknowledgment or consent box;

• Clicking a button indicating acceptance;

• Typing a name;

• Providing an electronic signature;

• Submitting an online form;

• Completing an electronic booking process; or

• Taking another affirmative action clearly associated with the applicable disclosure or agreement.

To the extent permitted by applicable law, electronic records and signatures may have the same legal effect as paper records and handwritten signatures.

We may maintain electronic records showing the date, time, content, transaction information, and other information associated with electronic acceptance.

28. INTELLECTUAL PROPERTY

The content of our website and promotional materials, including original logos, trademarks, business names, graphics, photographs owned by us, videos owned by us, text, designs, layouts, and other original content, is owned by or licensed to Broward Fingerprinting and protected by applicable law.

You may not copy, reproduce, distribute, modify, republish, sell, exploit, or use our intellectual property for commercial purposes without authorization.

29. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, services and website content are provided on an “as available” and “as is” basis, except for warranties that cannot lawfully be excluded.

We do not guarantee uninterrupted website availability, governmental processing times, agency acceptance, background screening outcomes, licensing decisions, third-party performance, or results outside our reasonable control.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be waived.

30. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Broward Fingerprinting, LLC and its owners, officers, employees, contractors, agents, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or related to services, website use, governmental decisions, third-party services, delays, interruptions, lost opportunities, lost profits, or other circumstances outside our reasonable control.

To the fullest extent permitted by applicable law, Broward Fingerprinting's aggregate liability arising from a particular service or transaction will not exceed the amount actually paid to Broward Fingerprinting for the service or transaction giving rise to the claim.

These limitations do not apply to liability that cannot lawfully be excluded or limited.

31. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Broward Fingerprinting, LLC and its owners, officers, employees, contractors, agents, and representatives from third-party claims, damages, losses, liabilities, and reasonable expenses arising from:

• False, inaccurate, fraudulent, or unauthorized information supplied by you;

• Your unlawful conduct;

• Your misuse of our website or services;

• Your violation of these Terms;

• Your violation of another person's rights; or

• Information or materials you submit without lawful authority.

This provision does not require you to indemnify Broward Fingerprinting for claims resulting solely from conduct for which indemnification is prohibited by applicable law.

32. FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL

Broward Fingerprinting is not responsible for delays or failure to perform caused by circumstances outside our reasonable control, including severe weather, hurricanes, floods, fires, power outages, internet outages, telecommunications failures, governmental system outages, cyber incidents affecting third parties, equipment failures despite reasonable maintenance, road closures, transportation disruptions, emergencies, acts of government, labor disruptions, epidemics, pandemics, natural disasters, or similar events.

We will make reasonable efforts to communicate with affected customers and reschedule or provide appropriate alternatives when practicable.

33. REFUSAL OR TERMINATION OF SERVICE

We reserve the right to refuse, suspend, or terminate service when reasonably necessary due to:

• Fraud or suspected fraud;

• Illegal activity;

• Safety concerns;

• Threats, harassment, abuse, or inappropriate conduct;

• Failure to provide required information or identification;

• Failure to pay authorized charges;

• Misuse of our services;

• Repeated violation of appointment policies;

• Requests that would require unlawful or unethical conduct; or

• Other legitimate business, legal, regulatory, or safety reasons.

We will not unlawfully discriminate in providing services.

34. COMPLAINTS AND DISPUTE RESOLUTION

We encourage customers to contact Broward Fingerprinting promptly regarding complaints or disputes so that we have a reasonable opportunity to investigate and attempt to resolve the matter.

Before filing a lawsuit arising from a service transaction, you agree to provide written notice describing the dispute and requested resolution and allow Broward Fingerprinting 30 days to respond and attempt an informal resolution.

This requirement does not prevent either party from seeking emergency injunctive relief, filing a claim before the applicable limitations period expires, or exercising rights that cannot lawfully be waived.

35. GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent permitted by law, legal proceedings arising from or relating to these Terms or services provided by Broward Fingerprinting shall be brought in a court of competent jurisdiction located in Broward County, Florida.

Nothing in this section prevents a party from bringing a claim in another venue when applicable law does not permit the venue requirement to be enforced.

36. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

Any invalid or unenforceable provision will be interpreted or modified to the minimum extent necessary to make it enforceable when permitted by law.

37. NO WAIVER

Failure by Broward Fingerprinting to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

38. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our written consent.

Broward Fingerprinting may assign or transfer its rights and obligations in connection with a merger, acquisition, sale of assets, corporate restructuring, change of control, or other lawful business transaction.

39. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, service-specific disclosures, booking policies, signed agreements, Media Releases, consent authorizations, and other terms presented in connection with a particular service, constitute the applicable agreement between you and Broward Fingerprinting concerning the subject matter addressed by those documents.

If a service-specific written agreement expressly conflicts with these general Terms, the service-specific agreement will control with respect to that conflict.

40. CHANGES TO THESE TERMS

We may update these Terms periodically to reflect changes in our services, business operations, technology, legal requirements, or other circumstances.

The Effective Date displayed at the top of these Terms indicates when the Terms were last updated.

Changes apply prospectively from the effective date unless otherwise required or permitted by law.
